New Jersey has adopted laws on the responsibilities of nursing homes in its Nursing Home Bill of Rights. Some of the more important responsibilities now being imposed upon nursing homes in New Jersey can be summarized as follows:
- Not admitting more residents than the facility can safely and adequately care for;
- Not using physical restraints, unless the facility is ordered to do so by the attending physician to protect the resident or others from injury;
- Not using drugs or medication for punishment or for any convenient reason that interferes with the resident’s rehabilitation or normal living activities;
- Allowing visitations from legal service programs or other assistance type groups;
- Complying with all applicable state and federal laws, rules and regulations.
Any violation of New Jersey’s Nursing Home Bill of Rights gives rise to a potential lawsuit where a successful party can recover treble (triple) damages, punitive damages, reasonable attorneys’ fees and costs.
